Why is it when people get drunk, get behind the wheel of thier car and kill someone, its vehicular homicide or manslaughter? You CHOOSE to get behind the wheel of a car knowing you are drunk. You KNOW what could happen if you drive drunk. And since you know the consequences and you still do it then that to me means pre-meditated and should be first-degree murder. Thoughts?

Just like the HIV thread a couple of weeks ago. Did the operator of the motor vehicle INTEND to kill somebody when behind the wheel impaired? If not, no first degree

He knows the consequences. He knows that there is a possibility that he could kill someone if he drives drunk. Therefor pre-meditated

I agree, if you willing get behind the wheel knowing that your judgment is impaired, then it should be considered first-degree murder, not vehicular homicide. No one can get me to believe that they do not know when they had too much to drink and can consciously get behind the wheel not knowing the consequences of their actions, this is preposterous. In regards to the HIV thread a few weeks ago, this person knowingly had the disease and chose not to tell as well as had unprotected sex, this too should be considered first-degree murder.

all i can say is if you're going to drink have a desicnated driver that wont drink 2 drive you home dont be stupid its not like it makes you seem uncool it acualy makes you seem very cool

A lot of drunk drivers think they're good enough drivers so that 'It won't happen' to them.

They're wrong, but that's not the point. That belief means it isn't 1st degree murder. They don't get behind the wheel and say to themselves "I'm going to kill someone tonight". They say "oh, I'm ok, I'll drive slower so I don't get in an accident" or something stupid like that.

My thing is that if you drink and drive you shouldn't put others at risk you could kill somebody.I'm glad that if you are caught that you do go to jail and they should before they danger someone else life

I agree with you, Alicia, but legally it isn't 1st degree murder. That was the original issue.

My late father was a career firefighter, and he told me about some of the things he saw due to drunk driving.....I will *NEVER* drive drunk...*ever*.

The intent is not there. Simple as that. Even though you know you can kill someone while drunk, that's not the intentions. If you read up on the different charges, it makes sense. It might not be morally right but it makes sense. The same thing if you were speeding and wasn't drinking and killed someone. The intent to kill someone is not there. I am excluding the cases that people are intending to kill someone with their car.

I believe this is a law that should be changed because there are too many incidents in which the driver was under the impression that he or she was capable of operating a motor vehicle while intoxicated. These cases are becoming every day occurrences and I would like to see our newly elected lawmakers rectify this by initiating a bill that will not only suspend a person’s license to drive but hold them accountable for charges other than vehicular manslaughter. In doing so, it would most definitely stop drinking and driving as well as spare some of the young lives we are losing around the world for idiots who believe they can handle a motor vehicle after having a liquid lunch or dinner. In regards to the intent not being there as Destany stated, I believe otherwise because that person intentionally got behind the wheel whether speeding or drinking and they knew the possibility of an accident occurring, which proves intent to me.

That proves intent to you but not the courts. Yes they intentionally got behind the wheel but they do not intentionally have the thought of killing someone even though they know the possibility. The intent could be to get to their designated place. You can't make your case base on a possibility because a drunk driver has many possibilites. It is a possibility that they can get home safely. It is a possibility that they could kill theirself. It's too many possibilites, therefore, the law can't go by that. So what was the drivers intentions, I bet it wasn't planned in their head to kill someone. See, these type of cases are not good for a jury because people make their own laws up based on their own beliefs regardless of what the law states.

The laws should be changed such that if you drink and drive and cause and accident of some sort you should get a minimum of 30 days in jail on the first offense. I think this would seriously reduce the amount of idiots driving on the road in this condition.

Hey BWVictim:

Would the 30 days replace a life in the event that the accident was to take one, I would think not, however, I too agree that the laws in this country should change regarding drinking and driving. I would like to see stiffer penalties, not just a license suspension, which is not enough to deter acts such as these, because drunks will continue to drive with or without a license.
